The preliminary decision recommends consenting to the placement of an environmental covenant on 0.03 acres, more or less, of DNR lands, as both grantor and grantee. The environmental covenant would restrict uses that could disturb contaminated soil remaining that is impracticable to remove due to the building foundation and underground utilities. The proposed activity and use limitations include administrative controls to limit the use of soil and groundwater within the restricted area.
