This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract ActionsU.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price purchase order to Atlantium Technologies LTD. This is a non-personal services contract to provide semi-annual (two times) a year maintenance on the installed real property of (2) UV light systems to ensure zebra mussel infestation of the raw water unit cooling system is controlled. This system was installed by and proprietary to Atlantium and makes them the only contractor who can perform the maintenance. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.
A SOLICITATION WILL NOT BE POSTED.The Government intends to proceed with this sole source action. The NAICS code is 811310, Commercial and Industrial Machinery and Equipment Repair and Maintenance. The size standard as defined by the U.S. Small Business Administration is $12.5M.THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS.
Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2pm CDT on 26 March 2025, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
