Notice of Intent to Include Open Market Items in Delivery Order for Administrative Convenience
This notice is issued in accordance with FAR 8.402(f), which allows the inclusion of items not on the Federal Supply Schedule (open market items) in a Federal Supply Schedule (FSS) delivery order for administrative convenience, provided all applicable requirements are met.
FHFA intends to issue a delivery order under an existing FSS contract that will include certain open market items. These open market items will be included solely for administrative convenience and will not be procured through the Federal Supply Schedule.
In accordance with FAR 8.402(f), the following conditions will be met:
All applicable acquisition regulations related to the open market items will be followed, including requirements related to publicizing, competition, commercial acquisition methods, and small business considerations. The Contracting Officer will determine that the prices for the open market items are fair and reasonable. The open market items will be clearly labeled on the order as such and will conform to the line item numbering requirements in FAR Subpart 4.10. All clauses applicable to the open market items will be incorporated into the delivery order.
The following open market items will be included in the delivery order issued to West Publishing Corporation (GSA Contract # GS-02F-026DA):
