NOTICE OF SOLE SOURCE INTENT

The Department of Labor (DOL), Office of Assistant Secretary of Administration and Management (OASAM), intends to award a sole source order in accordance with the authority of Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i) - Justification for Other Than Full and Open Competition to the following vendor:

The North American Industry Classification System (NAICS) code is 541519 - Other Computer Related Services with a size standard of $34M.
DOL, OSHA, Occupational Safety and Health Administration, Salt Lake Technical Center. (SLTC or Lab - 8660 South Sandy Parkway Sandy, Utah 84070), through the Office of the Chief Information Officer (OCIO) request to supply the software and deployment services for Empower 3.8 to the DOL Amazon Web Services (AWS) Cloud Hosting. The installation and deployment services for this transaction will be conducted in the DOL AWS test and production environments.

Waters Technologies Corporation is the sole manufacturer, supplier, distributor, and service provider for Waters Empower WGS FR5 SLC upgrade. The Requirement Specifications are attached. This action will result in a firm fixed price purchase order. The period of performance will commence on or about August 31, 2025.
Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not delay services.
The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement.
The Government will not be responsible for any costs incurred by responding to this notice.
