The Department of Commerce, National Institute of Standards and Technology (NIST), on behalf of the Office of Facilities and Property Management intends to contract on a sole source basis, with Washington Suburban Sanitary Commission to provide water and waste water utility services for the NIST campus in Gaithersburg Maryland. Washington Suburban Sanitary Commission (WSSC) is the only provider of such services in Montgomery County which serves Gaithersburg Maryland. NIST has a present and continuing requirement for water and sewer services for the daily operations of the campus.
FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. Authority 41 U.S.C. 3304(a) (1) (b) (3) When acquiring utility services (see 41.101 and 41.205), WSSC is the only provider of water and waste-water/sewer services in this area.
